CUSTOMER SATISFACTION;;

✧ I will do everything in my power to make my customer satisfied~!
✧ If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together.
✧ I am willing to change some terms if asked before work on the piece has begun, please be sure to reach out and let me know! [I.E. you do not want me to post the piece anywhere, ect.]

CONDENSED TOS;;

✧ X amount will be paid upfront in USD, this amount will be non-refundable.
✧ I have the right to refuse service for any reason, to anyone.
✧ This TOS is for personal use only, commercial use requests will need to contact me through email to negotiate pricing and terms of contract.
✧ I have the right to cancel the order at any given time. If canceled due to customer misbehavior, a refund is not granted.
✧ Images will be have a watermark, you are not to remove this under any circumstances.
✧ Means of communication and updates will be via Discord or Email, final product will be sent digitally in full via Email.
✧ Timeframe for completion is 1-2 months, this may vary depending on the size and complexity of the piece.
✧ If you go against any of the terms listed, cancelation without refunding can occur, banning from future services is possible under repeated or grievous instances.
✧ Customer has the right to three complete revisions in the sketching phase, and a reasonable amount of minor edits after completion [I.E. eye color change]
✧ Customer does not have the right to use the product in any blockchain-technology, including NFTs, cryptocurrency, or future inventions in the space.
✧ Customer does not have the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.
✧ No refunds.
✧ These terms are a living document, and can be updated at any time. Please keep yourself informed.

TERMS of SERVICE;;

This contract applies to the artist, Galactic_Ginyu, further called 'Seller', and a person, further called 'Customer', purchasing a work of art, further called 'Product'. By ordering this Product from the Seller, the Customer agrees to the following terms and conditions.

PAYMENTS;;

✧ Payment will be paid in USD$ via Paypal or Venmo. If other payment methods are required, discussion and agreement must be made before any work on the Product commences.
✧ Customer agrees to pay the due amount upfront for any orders of value lower or equal to 50$
✧ On orders above 50$, customer agrees to pay a 50$ down payment upfront. The remaining amount to be paid on approval of the initial sketch.
✧ Other payment schedules are available, but must be discussed and mutually agreed upon before any work on the Product commences.
✧ Customer agrees that work will not begin on Product until payment has been received by Seller according to agreed schedule.
✧ The 50$ down payment is non-refundable.

PRODUCT DELIVERY;;

✧ Customer agrees that Product will be delivered digitally to email address provided by Customer after final payment has been received by the Seller.
✧ Other methods of delivery are available, but must be mutually agreed upon before the work commences. Customer is obliged to bear any costs incurred by alternative delivery methods, such as postal costs, material costs, digital service subscription fees etc.
✧ It is the sole responsibility of Customer to propose a delivery method that works for both parties. Seller cannot be held responsible for loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.
✧ Upon delivery of the product, the Customer is solely responsible for storing it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.
✧ It is the sole responsibility of the Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller.

REVISIONS;;

✧ Customer has the right to 3 revisions during the sketching phase.
✧ Customer has the right to a reasonable amount of minor edits after completion of sketch, and completion of final product. Such as changing an eye color or fixing a small detail up to an additional 1hr of edits. Any requests beyond that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately and must be paid in full before revisions are made.
✧ If revisions are needed on something previously approved by Customer, a fee will be charged to change it.
✧ Revision fee is based on an hourly wage.

PROCESS;;

✧ Seller will notify you when they have started on Customer commission, and will make reviews with Customer throughout the sketch process to make needed adjustments.
✧ Communication for process will be done, preferably, VIA Discord or Email. Other means of communication are acceptable if discussed and agreed upon prior to the beginning of the Product.
✧ The time it takes to finish your commission may vary, typically time is 2 weeks - 2 months. Some Products may take longer, depending on complexity, personal matters, and other work. Seller will communicate with Customer about time-lines.
✧ If anything comes up that will slow the progress of the initially estimated delivery time, Seller will communicate with Customer ASAP.
✧ If Product is required by a certain deadline, Customer must communicate this deadline before beginning of Product, and must be mutually agreed upon.
✧ During reviews and updates, Customer will see work-in-progress pieces, these images will typically include a watermark and be smaller than the finished pieces. Sometimes they will be screenshots.

COPYRIGHT;;

I, the Seller, claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to promote myself with it everywhere, publish books with it, display it everywhere to my liking (social media, websites, ect.), and post it wherever I wish.✧ The Customer has the right to use the Product for personal use unless agreed otherwise (Customer can upload it to social media platforms, forums, ect.),
✧ The Customer has the right to print the Product and claim the character(s) as their own, but not the artwork itself.
✧ The Customer may use the artwork to promote themselves.
✧ Customer may not claim the artwork as their own, remove the Seller's watermark/signature, or alter the artwork without Seller's consent.
✧ The Product received by Customer is for personal use only. Any use of the Product for commercial purposes, reselling it, reproduction or publishing of reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.
✧ Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
✧ In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.

REFUND / CANCELLATION POLICY;;

✧ If for any reason the Seller is unable to start your commission after 2 months, you will receive a full refund.
✧ If Buyer cancel Prodyct before the final sketch is finished, the 50$ is non-refundable.
✧ If Buyer requests a Paypal chargeback at any point, they will lose all beforementioned rights to the commissioned piece and Seller will have the full right to profit further from it in any way. Seller will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, Buyer will be blacklisted from further commissioned Products.
